1. Who we are

These Terms and Conditions ("Terms") govern every purchase made on balmantejewelry.com (the "Store"). The Store is operated by:

"We", "us" and "our" mean Balmante Jewelry s.r.o. "You" means the customer placing an order. Where you buy as a consumer, nothing in these Terms limits the rights you have under the mandatory consumer law of the country where you live.

2. Placing an order and forming the contract

1. Product presentations on the Store are an invitation to order, not a binding offer.
2. By completing checkout you make a binding offer to buy the items in your cart at the price shown. You confirm that the details you entered are complete and correct.
3. The purchase contract is formed when we send the order confirmation e-mail. An automatic acknowledgement that your order was received is not yet an acceptance.
4. We may decline or cancel an order for a legitimate reason, for example a pricing or stock error, a suspected fraudulent transaction, or an order that appears to be placed for resale. If payment was already taken we refund it in full within 14 days.
5. We keep the contract (your order and confirmation) in our systems and send you a copy by e-mail. The contract is concluded in English.

3. Prices, currencies and payment

1. Prices are shown in the currency of your delivery country where available, otherwise in euro. Prices for delivery within the European Union include VAT.
2. For delivery outside the EU, prices do not include import duties, customs fees or local taxes. Where these apply they are set by your country, collected by the carrier on delivery and are your responsibility — with one exception: standard delivery to the United States is shipped duties-paid, so nothing is charged on arrival. DHL Express shipments, including to the United States, are not duties-paid.
3. Standard delivery is free of charge. DHL Express is optional and priced at checkout before you confirm the order.
4. We accept the payment methods displayed at checkout, currently card payments (Visa, Mastercard, Maestro, American Express, UnionPay) via Shopify Payments, Shop Pay, Apple Pay, Google Pay, Klarna, and local methods such as Bancontact, iDEAL, BLIK and MobilePay where available. Payment is due at the time of ordering; Klarna's own terms apply to Klarna purchases.
5. Discount codes cannot be combined unless stated otherwise, are not redeemable for cash, and we may end a promotion at any time for orders not yet placed.
6. If an obvious pricing error occurs we will contact you before dispatch; you may confirm the order at the correct price or cancel it free of charge.

4. Delivery

Delivery times, carriers and destinations are set out in our Shipping policy, which forms part of these Terms. Delivery times are estimates. If you are a consumer, risk of loss or damage passes to you when you (or a person you nominated) take physical possession of the goods.

5. Your right to cancel (right of withdrawal)

1. Statutory right. If you are a consumer in the EU or the UK, you may cancel the contract for any reason within 14 days of the day you (or a person you nominated, other than the carrier) received the goods.
2. Our extended right. We extend this to 30 days from delivery for every customer, worldwide, under the conditions in our Return & refund policy. Where the statutory right is more favourable to you, the statutory right applies.
3. How to cancel. Tell us clearly that you cancel — through the returns form, by e-mail to info@balmantejewelry.com, or by using the model withdrawal form at the end of these Terms. Sending the notice before the deadline expires is enough.
4. Returning the goods. Send the goods back without undue delay and no later than 14 days after telling us. You bear the direct cost of returning the goods unless the item was faulty or we sent the wrong item.
5. Refund. We refund all payments received from you, including the cost of standard delivery (but not any extra cost of an express option you chose), without undue delay and no later than 14 days after we are informed of your cancellation. We may withhold the refund until we have received the goods back or you have supplied proof of having sent them. We refund using the same payment method you used, unless you expressly agree otherwise.
6. Condition of goods. You may inspect the goods as you would in a shop. You are liable for any diminished value resulting from handling beyond what is necessary to establish their nature, characteristics and functioning — for example jewellery that has been worn.
7. Exceptions. The right to cancel does not apply to goods made to your specification or clearly personalised, in particular solid gold pieces, custom sizes outside our standard range, and engraved items. We tell you before you order when a product is custom-made.

6. Faulty goods and your legal guarantee

1. We are responsible for goods that do not conform to the contract at the time of delivery. For consumers in the EU this liability lasts two years from delivery; a defect appearing within the first twelve months is presumed to have existed at delivery unless we prove otherwise. Consumers in the UK have the rights set out in the Consumer Rights Act 2015.
2. If goods are faulty you may ask for repair or replacement, and where that is not possible or not done within a reasonable time, a proportionate price reduction or a refund. The full procedure, timelines and what counts as a defect are in our Warranty & complaints policy.
3. We handle complaints in line with Czech law: we decide on a complaint without undue delay, in complex cases within three working days, and settle it within 30 days of receiving it, unless we agree a longer period with you.

7. Balmante 2-year warranty

In addition to your legal rights we give a commercial warranty of 24 months from purchase covering defects in materials and workmanship. This warranty does not replace or reduce your legal guarantee. Its scope, exclusions (such as normal wear of gold plating, loss, or damage caused by improper use) and the claim procedure are set out in the Warranty & complaints policy.

8. Product information

Our jewellery is made of 925 sterling silver, either in its natural finish or plated with 18K gold, and set with laboratory-created stones unless a product page states otherwise. Colours may render differently on screens. Plating is a surface finish and will develop a gentle patina with wear; this is a characteristic of plated jewellery, not a defect. 9. Our liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, for breach of your statutory consumer rights, or for any liability that cannot lawfully be excluded. Subject to that, we are not liable for losses that were not foreseeable to both of us when the contract was made, or for business losses. Our total liability for any order is limited to the amount you paid for that order.

10. Intellectual property

The Balmante name, logo, designs, photographs and text on the Store are protected by copyright and trademark law and belong to us or our licensors. You may not reproduce them without our written permission.

11. Personal data and cookies

We process your personal data as described in our Privacy policy and use cookies as described in our Cookie policy.

12. Complaints and dispute resolution

1. If you are unhappy with anything, please contact us first at info@balmantejewelry.com; we will do our best to resolve it.
2. Consumers in the Czech Republic and the EU may use out-of-court dispute resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Praha 2, www.coi.cz, or another authorised body in your country.
3. The Czech Trade Inspection Authority is also our supervisory authority for consumer protection; the trade licensing office supervises our trade licence.

13. Governing law and jurisdiction

These Terms and any contract made under them are governed by the law of the Czech Republic. If you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you live, and you may bring proceedings in the courts of that country.

14. Changes to these Terms

We may update these Terms. The version in force when you place an order is the one that applies to that order. The date at the top shows when the current version took effect.
